Terms of Service

1. Who may use ThinkBub

You must be at least 16 years old to use the Service. You must also be old enough to enter into a binding contract where you live. If you are not, your parent or legal guardian must review and accept these Terms for you, but the Service is never available to anyone under 16.

You may not use the Service if doing so would violate applicable law, if we previously terminated your account for serious or repeated violations, or if you are subject to sanctions that prohibit your use of the Service.

If we learn that an account belongs to someone under 16, we may suspend or delete it and its associated information.

2. Your account

Provide accurate information, keep your login credentials secure, and promptly tell us at [email protected] if you believe your account has been compromised. You are responsible for activity performed through your account unless it results from our failure to use reasonable security measures.

Usernames and other identifiers are provided on a first-come basis, but we may reclaim or change them when reasonably necessary to address impersonation, trademark concerns, inactive or deleted accounts, security, or confusion with ThinkBub and its features.

3. The Service and Bubbles

ThinkBub lets people create and join communities called Bubbles, publish threads and replies, upload media, react to content, and use community and account controls. Some Bubbles may offer subscriber-only forums, threads, archives, or videos.

Bubble owners and moderators are users, not ThinkBub employees or agents. They may create reasonable local rules and take local moderation actions. Local rules may be stricter than our Community Guidelines but may not authorize conduct those Guidelines prohibit. ThinkBub may review or reverse local actions, remove content, restrict a Bubble, or take platform-wide action when needed to protect users, the Service, or others.

We may add, change, suspend, or discontinue features. We will try to provide reasonable notice when a change materially reduces a paid feature, when practical.

4. Your content

Your ownership. You retain the rights you already have in content you submit, post, or upload to the Service (Your Content). You are responsible for Your Content and must have all rights and permissions needed to share it.

License to operate the Service. You grant ThinkBub a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to host, store, reproduce, process, adapt for technical purposes, publish, display, distribute, and make Your Content available only as reasonably necessary to operate, secure, improve, promote, and provide the Service. For example, this lets us resize an image, transcode a video, generate a link preview or social preview, display a post to other users, and use service providers to host or deliver it.

This license ends when Your Content is deleted from our systems, except to the extent:

• other users have copied, quoted, or shared it through the Service;
• continued use is reasonably necessary for backups, security, fraud prevention, legal compliance, dispute resolution, or enforcing these Terms; or
• you separately gave us permission to use it outside the ordinary operation of the Service.

Public content. ThinkBub is primarily a public discussion service. Content posted outside a clearly identified subscriber-only or otherwise restricted area may be viewed, copied, indexed, linked to, or shared by anyone. A restricted area limits access through ThinkBub; it does not guarantee that another user will not copy or disclose what they see.

Feedback. If you send us product ideas or feedback, you allow us to use them without restriction or compensation. This does not give us ownership of Your Content.

5. Acceptable use

You must follow the Community Guidelines. You may not misuse the Service, help someone else misuse it, or attempt to do any of the following:

• break the law or infringe another person's rights;
• access accounts, systems, or data without authorization;
• scrape, crawl, harvest, or use automated means to access the Service except as allowed by our published instructions or written permission;
• evade access controls, bans, rate limits, subscription gates, or security measures;
• upload malware, disrupt the Service, or impose an unreasonable load on it;
• manipulate engagement, create deceptive accounts, spam, or engage in fraud;
• reverse engineer the Service except where applicable law expressly permits it; or
• use content from the Service to train or improve a machine-learning model without our and the applicable rights holders' permission.

6. Copyright and other rights

We respect intellectual-property rights. Our Copyright and DMCA Policy explains how to report claimed copyright infringement and submit a counter-notice. We may remove or restrict content and may terminate repeat infringers in appropriate circumstances.

7. Subscriptions and payments

For subscribers

Some Bubbles offer monthly or yearly recurring subscriptions. The price, billing interval, and included access are shown before checkout. Payments are processed by Stripe.

Subscriptions renew automatically at the displayed interval until canceled. By subscribing, you authorize recurring charges to your selected payment method, including applicable taxes. You can cancel through ThinkBub's subscription settings or the Stripe billing portal. Unless the Service tells you otherwise, cancellation takes effect at the end of the period you already paid for: you keep access until then and are not charged again.

Payments are non-refundable except where required by law or where ThinkBub decides otherwise. Canceling does not automatically refund the current period. If paid content is removed, a Bubble closes, or access ends because of moderation, we may stop renewal, provide a full or partial refund, or take another reasonable step depending on the circumstances and applicable law.

Bubble owners control their content and may change what they publish. A subscription supports access to a Bubble's subscriber offering; it is not a promise that any particular volume or type of content will always be available.

For Bubble owners receiving payouts

To earn subscription revenue, you must complete Stripe's onboarding, maintain an eligible connected account, provide accurate tax and identity information, and comply with the Stripe Connected Account Agreement and applicable law.

ThinkBub currently charges a platform fee equal to 10% of each Bubble subscription price. Bubble owners also bear Stripe's payment-processing and recurring-billing fees, which are deducted from creator proceeds in addition to ThinkBub's platform fee. The amount shown in the creator interface is an estimate before Stripe fees and may differ from the final payout because of taxes, refunds, disputes, currency effects, adjustments, and amounts Stripe is permitted to deduct or hold.

You authorize ThinkBub to create and manage subscription products and prices, initiate charges and transfers, pause or disable payouts, issue or fund refunds, respond to disputes, and take related activity through your connected Stripe account as reasonably necessary to provide the subscription feature and comply with law and payment-network rules.

You are responsible for the content and benefits you promise subscribers and for your taxes on creator earnings. Do not describe a subscription as a charitable donation or investment. We do not guarantee revenue, subscriber retention, payout timing, or uninterrupted payment processing. Stripe or ThinkBub may delay, withhold, reverse, or suspend payouts where required for verification, refunds, disputes, suspected fraud, legal compliance, negative balances, or violations of these Terms.

If Bubble ownership changes, a Bubble is archived or deleted, the owner disconnects payouts, or subscriptions are disabled, renewals and access may end as described in the Service. ThinkBub may apply later price decreases to existing subscribers at renewal. Price increases do not apply to an existing subscription unless the subscriber receives legally required notice or affirmatively agrees where required.

8. Third-party services and links

The Service uses or links to third-party services, including Stripe, Google, Cloudflare, Bunny, Mux, and Klipy. Their own terms and privacy policies may apply to your use of their services. We are not responsible for third-party websites, content, or services we do not control.

9. Moderation, suspension, and termination

You may deactivate your account and return later by signing in, or request account deletion in Settings. Deactivation is reversible. Deletion ends your access and triggers the account-deletion process, but some content and records may remain as described in the Privacy Policy and Section 4 above.

We may remove content, limit features or visibility, stop subscription renewals, suspend or terminate accounts or Bubbles, or preserve information when we reasonably believe it is necessary to:

• enforce these Terms or the Community Guidelines;
• prevent harm, fraud, abuse, or security incidents;
• comply with law or a valid legal request;
• protect ThinkBub, our users, or others; or
• address risk to payment services or the operation of the Service.

Where appropriate, we may provide notice and an opportunity to appeal. We may act without advance notice in urgent or serious cases.

Sections that by their nature should survive termination—including ownership, licenses already relied upon, payment obligations, disclaimers, limitations of liability, indemnity, and dispute terms—will survive.

10. Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available.” ThinkBub disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, and uninterrupted or error-free operation.

We do not endorse or guarantee user content, the conduct of users or Bubble moderators, creator earnings, subscriber content, or third-party services. Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

11. Limitation of liability

To the fullest extent permitted by law, ThinkBub and its owners, officers, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, goodwill, or opportunities, arising from or related to the Service.

To the fullest extent permitted by law, our total liability for all claims arising from or related to the Service will not exceed the greater of (a) the amount you paid directly to ThinkBub during the 12 months before the event giving rise to the claim or (b) US $100.

These limits do not apply where prohibited by law or to liability that cannot legally be limited.

12. Indemnity

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless ThinkBub and its owners, officers, employees, contractors, and affiliates from claims, damages, losses, liabilities, and reasonable costs (including legal fees) arising from Your Content, your misuse of the Service, your violation of these Terms, or your violation of another person's rights. This section does not require you to indemnify anyone for their own fraud, gross negligence, or willful misconduct, and it applies only to the extent permitted by law.

13. Governing law and disputes

These Terms are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to conflict-of-law rules. Any dispute that is not resolved informally will be brought exclusively in the state or federal courts located in Montgomery County, Pennsylvania, and you and ThinkBub consent to those courts' jurisdiction.

Before filing a claim, you and ThinkBub agree to make a good-faith effort to resolve it by sending a written description of the issue and requested resolution to the contact information below and allowing 30 days for a response. Either party may seek urgent injunctive relief when necessary to prevent immediate harm.

Nothing in this section limits rights you cannot waive under the law where you live.

14. Changes to these Terms

We may update these Terms. We will post the revised version and update the date above. If a change materially affects your rights, we will provide reasonable additional notice, such as an in-service notice or email. Changes apply prospectively from their stated effective date. Your continued use after that date means you accept the revised Terms; if you do not agree, you must stop using the Service.

15. General terms

These Terms, together with the policies incorporated into them and any terms shown at purchase, are the entire agreement between you and ThinkBub about the Service. If a provision is unenforceable, it will be limited to the minimum extent necessary and the rest will remain effective. Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent. We may transfer them as part of a merger, acquisition, reorganization, asset sale, or by operation of law.
